Terms of Use (EULA)

Important: By downloading, installing, or using DiabetesFit, you agree to be bound by these Terms of Use ("Terms" or "EULA"). If you do not agree to these terms, please do not use the app.

1. Acceptance of Terms

These Terms of Use ("Terms" or "EULA") govern your access to and use of the DiabetesFit mobile application ("App"), including any content, functionality, and services offered through the App. By using DiabetesFit, you accept and agree to be bound by these Terms.

2. Medical Disclaimer

DiabetesFit is NOT a Medical Device

DiabetesFit is an educational and tracking tool designed to help users manage diabetes-related information. It is not a medical device, does not provide medical advice, and should not replace professional medical consultation.

You agree that:

The App provides educational information and tracking capabilities only
No content in the App constitutes medical advice, diagnosis, or treatment
You will consult with qualified healthcare professionals before making any medical decisions
You will not rely solely on the App for diabetes management
The App's suggestions are educational and not prescriptive medical recommendations
You are solely responsible for your health decisions and diabetes management

3. App Functionality

3.1 Free Features

DiabetesFit offers free features including:

Basic glucose, insulin, and meal tracking
HealthKit integration for reading CGM data
Access to Swiss food database
Apple Watch companion app
Basic widgets

3.2 Premium Subscription

Premium features require an active subscription and include:

PDF report generation
Interactive educational visualizations
Advanced analytics and insights
iCloud synchronization across devices
Unlimited data storage
AI-powered timing recommendations

4. Subscription Terms

4.1 Subscription Plans

DiabetesFit offers the following auto-renewable subscription plans:

Monthly Subscription: CHF 4.90 per month
Annual Subscription: CHF 39.90 per year

4.2 Free Trial

New subscribers may receive a 7-day free trial. After the trial period, your subscription will automatically renew unless cancelled at least 24 hours before the trial ends.

4.3 Payment and Renewal

Payment will be charged to your Apple ID account at confirmation of purchase
Subscriptions automatically renew unless auto-renew is turned off at least 24 hours before the end of the current period
Your account will be charged for renewal within 24 hours prior to the end of the current period
You can manage and cancel subscriptions in your Apple ID Account Settings

4.4 Cancellation

You may cancel your subscription at any time:

Open Settings on your iPhone
Tap your name → Subscriptions
Select DiabetesFit subscription
Tap "Cancel Subscription"

Cancellation takes effect at the end of the current billing period. No refunds will be provided for partial subscription periods.

4.5 Pricing Changes

We reserve the right to modify subscription pricing. Price changes will be notified in advance and will not affect existing subscriptions until renewal.

5. Data Storage and Sync

5.1 Local Storage

All data is stored locally on your device using Apple's SwiftData framework. We do not have access to your health data stored locally.

5.2 iCloud Sync (Premium)

Premium subscribers can enable iCloud synchronization:

Data syncs via your personal iCloud account
We do not have access to your iCloud data
Sync is managed entirely by Apple's CloudKit
You control what data is synced through your device settings

5.3 HealthKit Integration

DiabetesFit integrates with Apple HealthKit to:

Read continuous glucose monitor (CGM) data
Display glucose readings in the app

HealthKit permissions are requested when you first use the app. You can modify these permissions in iOS Settings at any time.

6. User Responsibilities

You agree to:

Provide accurate information when using the app
Use the app in compliance with applicable laws
Not attempt to reverse engineer, decompile, or extract source code
Not use the app for any illegal or unauthorized purpose
Maintain the confidentiality of your device and Apple ID
Consult healthcare professionals for medical decisions

7. Intellectual Property

The App and its original content, features, and functionality are owned by DiabetesFit and are protected by international copyright, trademark, and other intellectual property laws.

8. Limitation of Liability

Important Legal Notice

TO THE MAXIMUM EXTENT PERMITTED BY LAW, DIABETESFIT SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES RESULTING FROM:

Your use or inability to use the App
Any unauthorized access to or use of your data
Any interruption or cessation of transmission to or from the App
Any bugs, viruses, or other harmful code
Any errors or omissions in any content
Medical decisions made based on App information

9. Disclaimer of Warranties

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

10. Indemnification

You agree to indemnify, defend, and hold harmless DiabetesFit and its officers, directors, employees, and agents from any claims, liabilities, damages, losses, costs, or expenses arising from:

Your use of the App
Your violation of these Terms
Your violation of any third-party rights
Medical decisions made based on App use

11. Changes to Terms

We reserve the right to modify these Terms at any time. Changes will be effective immediately upon posting the updated Terms in the App. Your continued use of the App after changes constitutes acceptance of the modified Terms.

12. Termination

We may terminate or suspend your access to the App immediately, without prior notice, for any reason, including breach of these Terms. Upon termination:

Your right to use the App will cease immediately
Subscription benefits will end
Local data on your device remains yours
No refunds will be provided for unused subscription periods

13. Governing Law

These Terms shall be governed by and construed in accordance with the laws of Switzerland, without regard to its conflict of law provisions.

14. Dispute Resolution

Any disputes arising from these Terms or your use of the App shall be resolved through good faith negotiation. If negotiation fails, disputes shall be subject to the exclusive jurisdiction of the courts in Switzerland.

15. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will remain in full force and effect.

16. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and DiabetesFit regarding the App and supersede all prior agreements.

18. Apple Terms

These Terms are between you and DiabetesFit only, not with Apple Inc. Apple is not responsible for the App or its content. Apple has no obligation to provide maintenance or support services. In the event of any failure of the App to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price (if any). To the maximum extent permitted by law, Apple will have no other warranty obligation with respect to the App.
